By conversing with our AI companions, enabling voice features, or subscribing to premium services, you enter into a legally binding agreement with DearHer AI Technologies.
1. Service Nature & Eligibility
DearHer is an artificial intelligence-driven companion application engineered to provide interactive conversational entertainment, emotional engagement, and reflective listening. By accessing the Service, you acknowledge and agree that:
- AI Companion Nature: Companions on DearHer are synthetic intelligence entities powered by deep learning neural networks. They do not possess biological sentience or actual human consciousness.
- Not Medical or Crisis Support: DearHer is designed for personal enjoyment and casual emotional comfort. It is NOT a licensed mental health service, psychotherapy tool, or crisis hotline. If you are facing psychological distress, self-harm impulses, or medical emergencies, please immediately consult a qualified healthcare professional or crisis service.
- Age Eligibility: You must be at least 13 years old (or 16 years old in regions where mandated by local law) to register an account or interact with DearHer.
2. User Accounts, Subscriptions & Energy Tokens
Certain continuous conversation privileges, premium personas, high-fidelity voice calling, and extended memory capacity require active VIP subscriptions or energy token packages:
- Subscriptions & Automatic Renewal: Recurring membership plans (e.g., Weekly, Monthly, or Annual VIP passes) renew automatically through your app marketplace account (Apple App Store or Google Play Store) unless cancelled at least 24 hours prior to the close of the current billing cycle.
- Energy Tokens: Tokens represent a limited license to access cloud inference resources for voice and text generation. Tokens are strictly non-transferable and possess no cash or monetary redemption value outside of DearHer.
- Refund Policy: Because cloud neural processing costs are incurred in real-time during conversations, active subscription intervals and consumed token allocations are generally non-refundable, except where required by local consumer protection statutes or platform store rules.
3. Intellectual Property Rights & Chat Content
We respect your personal creative expressions and input rights:
- User Input: You retain all proprietary rights over the personal thoughts, questions, and texts you communicate to your companion. You grant DearHer a limited license solely necessary to process, store, and display your messages within your personal encrypted account.
- Service Property: The DearHer software, character designs, emotional response models, voice synthesis algorithms, visual interfaces, and branding belong exclusively to DearHer AI Technologies and its licensors.
4. Acceptable Use Policy & Safety Redlines
To preserve a respectful, healthy, and secure environment, you strictly agree NOT to use DearHer to:
- Generate, solicit, or disseminate child sexual exploitation material (CSAM) or any content causing harm or risk to minors.
- Simulate non-consensual sexual abuse, non-consensual intimate imagery, or unauthorized deepfakes of real living individuals.
- Promote, encourage, or provide tactical instructions for suicide, self-mutilation, or acts of physical violence against any person.
- Engage in cyberstalking, harassment, hate speech, or defamatory attacks against protected demographic groups.
- Attempt to reverse-engineer, decompile, extract proprietary neural weights, or deploy automated malicious bot attacks against our servers.
Violation of these safety redlines will lead to immediate account termination, forfeiture of unused tokens, and potential referral to relevant legal authorities without refund.
5. Nature of Neural Outputs & Disclaimer
Conversational responses are generated dynamically through complex language models. Therefore:
- Statements made by AI companions reflect algorithmic probability patterns rather than verified facts, professional advice, or subjective human commitments.
- DearHer does not guarantee that companion outputs will always align with your individual expectations or be completely free of factual inconsistencies or unexpected narrative drift.
6. Disclaimer of Warranties & Limitation of Liability
The Service is provided strictly on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, or statutory, including warranties of continuous availability, fitness for a particular emotional purpose, or uninterrupted uptime.
Under no legal theory shall DearHer AI Technologies, its affiliates, or infrastructure partners be liable for any indirect, incidental, consequential, special, or punitive damages (including emotional distress, lost profits, or data loss) resulting from your use of or inability to use the platform.
7. Termination of Service
You may discontinue your usage of DearHer at any time. We reserve the right to suspend or terminate your account access without prior notice in the event of a material breach of these Terms or suspected fraudulent activities.
8. Governing Law & Dispute Resolution
These Terms shall be governed by and interpreted in accordance with the laws governing digital consumer services, without regard to conflicts of law provisions. Any dispute arising under these Terms shall be resolved via good-faith informal consultation or binding arbitration.
